What our apps do (and don't) host
Deus Core makes software tools. We don't sell, host or provide music, videos, lyrics or other people's content. Depending on the app, content may be played from the user's own device, shown in another site's embedded player, or shared by other users (for example community song sheets). Each app's page or product terms explain what it does.
When content is hosted by another site, please also send your notice to that site, since only they can remove it there. What we can do is disable access to the material through our apps and act against repeat infringers.
How to send a copyright notice
Send a written notice to our agent that includes (17 U.S.C. § 512(c)(3)):
- your physical or electronic signature (typing your full name is fine), as the copyright owner or someone authorized to act for them;
- identification of the copyrighted work you say is infringed (or a list, if one notice covers several works);
- which app, and the exact link(s) or other information that lets us find the material;
- your name, address, phone number and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law;
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.
When we receive a complete notice, we act quickly to remove or disable access to the identified material and record the notice. Notices missing required parts may not be acted on; we may ask for the missing details.
Counter-notices
If material you added was removed and you believe it was a mistake or misidentification, send a counter-notice to our agent that includes (17 U.S.C. § 512(g)(3)):
- your physical or electronic signature;
- identification of the material that was removed and where it appeared before;
- a statement under penalty of perjury that you have a good-faith belief it was removed or disabled as a result of mistake or misidentification;
- your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the U.S., any judicial district where Deus Core may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We will send a copy of your counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action, we may restore the material 10 to 14 business days after we receive your counter-notice.
Repeat-infringer policy
Deus Core maintains a policy providing for the restriction or termination of access for people who repeatedly infringe copyright or repeatedly submit material that infringes copyright. We consider the circumstances, severity, frequency and history of reported violations when deciding what to do, which can include blocking connections, licenses or passes. We may also act against anyone who tries to get around a block.
False claims
Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages, including costs and lawyers' fees. If you aren't sure whether something infringes your rights, consider talking to a lawyer first.
Records
We keep records of the notices and counter-notices we receive and what we did about them, generally for up to 3 years. Other questions: [email protected].
